ESMA Sets Three-Month Deadline for Non-MiCA Stablecoin Services
ESMA says MiCA-authorised crypto firms should stop EU services tied to non-compliant stablecoins and resolve existing exposures within three months.
ESMA says MiCA-authorised crypto service providers should stop serving EU clients with non-compliant stablecoins and remediate existing exposures within three months.
The European Securities and Markets Authority published an opinion on October 8 stating that crypto-asset service providers authorised under the Markets in Crypto-Assets Regulation should stop providing European Union clients with services related to asset-referenced tokens and e-money tokens that do not comply with MiCA. The regulator also said remaining pre-existing exposures should be remediated as soon as possible and no later than three months after the opinion’s publication.
The opinion is a supervisory instruction for national authorities and regulated service providers. It is not a list of banned tokens, and ESMA did not name individual stablecoins in its public announcement. Readers can follow further regulatory developments through the OrangeX.com news hub.
Which services are covered
ESMA said the expectation applies across the full range of crypto-asset services covered by MiCA. That includes operating trading platforms, exchanging crypto-assets, executing and placing orders, receiving and transmitting orders, providing investment advice, transferring assets, custody and administration, and portfolio management.
National competent authorities should ensure firms do not maintain, introduce or facilitate EU client access to non-compliant stablecoins. ESMA also called for technical, contractual and organisational controls that prevent clients from acquiring or increasing exposure. What the three-month window means
Where firms still hold pre-existing client exposure, supervisors should require remediation as soon as possible and within three months. Limited services may continue only when necessary for liquidation, conversion, withdrawal, transfer or safekeeping, and those activities should remain time-limited, risk-based and closely supervised.
This distinction matters. The opinion does not say that customer assets should be seized or made inaccessible without an exit route. It instead describes a controlled wind-down in which clients can reduce or move existing positions while new or increased exposure is blocked.
What firms and users should verify
Service providers will need to map every affected product and workflow, including trading, custody, transfers, advice and portfolio functions. They may also need to update terms, access controls, onboarding rules and communications for EU clients. Users should verify the status of a stablecoin and the services available in their jurisdiction through their provider’s official notices. Token status may depend on authorisation, issuer structure and the exact service being offered. The ESMA opinion itself does not determine that every stablecoin is non-compliant.
OrangeX.com Analysis
The practical effect will depend on consistent national supervision and on how clearly firms distinguish restricted acquisition from permitted exit and safekeeping functions. The three-month ceiling creates a firm timetable, but implementation may differ by product and existing client exposure.
The strongest compliance approach is likely to combine token-level eligibility checks with controls across every service layer. Unresolved questions include which tokens national authorities will identify, how cross-border accounts will be treated and how providers will communicate conversion or withdrawal options. Those points require confirmation from supervisors and individual firms.
