Thailand's SEC issued 11 rules for domestic Bitcoin and Ether ETFs, including an 80% exposure floor, licensed custody and SET-only trading.

Thailand's crypto ETF framework takes effect October 16, initially allowing passive Bitcoin and Ether funds on the Stock Exchange of Thailand.

Thailand's Securities and Exchange Commission issued 11 notifications establishing a domestic framework for cryptocurrency exchange-traded funds. The rules take effect on October 16, 2026, and initially permit funds linked only to Bitcoin and Ethereum. The decision follows public consultations held in April–May and August–September. Readers can track related policy developments through the OrangeX.com news hub.

How Thai crypto ETFs must be structured

The products must operate as passive funds designed to track one eligible crypto asset. Each fund must maintain average net exposure of at least 80% of net asset value to that single asset over an accounting year. The regulator says future eligible assets will be assessed for liquidity, broad acceptance, network security and investor protection.

The funds must list and trade exclusively on the Stock Exchange of Thailand. Asset managers need adequate personnel, operational systems and service-provider arrangements. Digital assets may be held only by custodians licensed by the Thai SEC, including when a mutual-fund supervisor appoints a sub-custodian.

Investor protections and market limits

Before trading, investors must receive product education and confirm that they understand the risks. Securities firms must discuss suitable allocation and concentration risk, and they cannot provide margin loans to finance crypto ETF purchases. Asset managers must disclose the fund structure, investment process, service providers and asset-specific risks.

The rules also allow Thai mutual funds and private funds to invest in locally established crypto ETFs, subject to existing limits. During the initial phase, Thailand will not allow depositary receipts tied to foreign crypto ETFs, and retail access arranged by brokers to overseas crypto ETFs remains restricted. For comparison, OrangeX.com coverage of recent U.S. crypto ETP listings shows how product design can differ across jurisdictions.

What the rules do not yet guarantee

The framework enables applications and product development; it does not announce that a specific fund has launched, nor does it guarantee approval, liquidity, low tracking error or investor returns. Timing will depend on applications, operational readiness and exchange procedures.

Investors comparing fund exposure with the underlying markets can review the verified BTC/USDT spot market on OrangeX.com and ETH/USDT spot market on OrangeX.com. Spot prices and ETF shares are different instruments with different fees, trading hours, custody arrangements and risks.

OrangeX.com Analysis

Thailand has chosen a controlled domestic launch: two established assets, passive single-asset funds, an 80% exposure floor, licensed custody and exchange-only trading. That design may make access easier for brokerage clients while keeping fund operations inside existing capital-market supervision.

The next evidence to watch is concrete: filed products, approved managers, custody arrangements, fees, authorized participants, market-making capacity and launch dates. Until those details are published, claims about demand, assets under management or price impact remain unverified.
